That scene is the reason I won't ever watch this movie again. It just so incredibly real and depressing. It shatters any illusion you may have that you will be a hero in a dire situation like that.

  ... because I said so. Stupidity may be a defense if the standard being applied requires knowledge that the statements in question are likely to cause damage to another. If those statements are true, no problem, that's a complete defense. If they're not, the lawyers get to duke it out in court.
  Most often, that won't come into play though since a lot of states assume that the person making the false statements does so with the requisite guilty state of mind. It's not universal though which is why the non-stick dick might get away with this too.
