I can see why people say that, but I disagree with the sentiment. If they weren't rights then the erosion was not needed the actions could take place as it was not taboo or culturally sensitive. The fact it happened faster during 911 ignores that this was an opportunity to what was being done slowly over time, so it was not quite so easy.

Sometimes legality isn't what matters, but the perception of what is legal to any given cop. Perhaps part of what is happening here. My opinion is that they might be trying to set precedent to phone searching and data protection to intimidate activists as well.
