The allegation seems to stem from double hearsay in a document authored by a later suspended police detective.
Apparently leaving El Salvador because of extortion, threats to the lives of you and your family, and refusing to become a member of MS 13 makes one an MS-13 member and a terrorist.
I think the guy is dead, and they're trying to keep it under wraps.
If the reporting I read about threats against his life, family, attempted recruitment (and refusal) into MS 13, etc. You may very well be right.
It's truly bizarre that the accusation of being a gang member was upheld by the judge, due to him "failing to present evidence" that he was not a gang member. How the fuck is he supposed to provide evidence of something that doesn't exist?
